K-pop Idol Appeals Light Punishment, Accused of Exploiting Fans in a Crime

Himchan, a former member of the boy group B.A.P, who has been indicted on charges of sexual assault and indecent assault, has received a suspended sentence in the first trial, and the prosecution has appealed.

According to the legal community, on the 7th, the Seoul Western District Prosecutor’s Office filed an appeal against Himchan, who was indicted on charges of rape, violation of the Sexual Violence Punishment Act (filming using a camera, obscene acts using communication media), and was sentenced to three years in prison and a five-year suspended sentence in the first trial.

The prosecution explained the reason for the appeal, stating, “The defendant cunningly committed the crime using fan sentiment, threatened and assaulted the victim, and then filmed illegally; the quality of the crime is terrible, and considering that he committed another crime while being tried for the same type of crime.”

Himchan is accused of sexually assaulting victim A in Eunpyeong-gu, Seoul, in May 2022 and then illegally filming and sending pictures taken at the time of the crime to A. At the time, Himchan was on trial for allegedly touching the bodies of two women at a bar in Hannam-dong, Yongsan-gu, in April of the same year.

In response, the prosecution sought a seven-year prison term, citing the victims’ severe mental anguish in light of the method and circumstances of the crime, the number of times, and the fact that he committed another indecent assault while on trial. However, the first trial court sentenced him to three years in prison and a five-year suspended sentence, taking into account that Himchan admitted all the crimes and reached an agreement with the victim.

Meanwhile, Himchan, who has stirred controversy with three sexual offenses, is currently serving a 10-month prison sentence for sexually assaulting a woman in her 20s at a pension house in Namyangju, Gyeonggi Province, in 2018.
